Welcome to Broadacre Contracting. These Terms of Service govern your use of our website [broadacrecontracting.au] and the services provided through it.

1. Acceptance of Terms

   • By accessing or using our website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not access the website or use our services.

2. Use of Services

   • Access: You must be at least 18 years old and capable of forming a binding contract to use our services. By using our website, you represent that you meet these requirements.

   • Account: You may need to create an account to access certain features or services. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

   • User Conduct: You agree not to use our website for any unlawful or unauthorised purpose, or in any manner that could damage, disable, overburden, or impair our servers or networks.

3. Payment & Billing

   • Payment Processor: All card payments are processed by Stripe Payments Australia Pty Ltd (“Stripe”). By paying through our site you also agree to the Stripe Services Agreement and any Stripe-specific terms that apply to your selected payment method.

   • Authorisation: You authorise Broadacre Contracting (or Stripe acting on our behalf) to charge the payment card you nominate for all fees, taxes and other amounts incurred.

   • Pricing & Taxes: Prices are in Australian dollars and include GST unless otherwise stated. You are responsible for any other applicable taxes or duties.

   • Updates to Fees & Payment Methods: We may add or remove payment methods or revise fees on at least 14 days’ notice. Continuing to use paid services after the notice period constitutes acceptance of the new fees.

   • Refunds & Cancellations: We follow the Australian Consumer Law and Stripe’s refund flows. If you are entitled to a refund we will instruct Stripe to credit the original card; timing depends on the card network and issuing bank. Disputes and chargebacks after a full refund are not possible.

     • By opting into a subscription plan you authorise us and Stripe to automatically charge your nominated card at the interval you select until you cancel in accordance with Refunds & Cancellations.

   • Chargebacks & Disputes: You agree to contact us first to resolve any payment issue. If you lodge a chargeback contrary to these Terms we may suspend or terminate your account and recover related costs.

   • Failed or Late Payments: If a payment fails or is reversed, we may suspend access to services until all outstanding amounts (including any Stripe dispute fees) are paid.

   • Security: We never store complete card numbers; Stripe handles all card data in accordance with PCI-DSS level 1.

4. Identity Verification

   • Requirement: To remove all ‘unverified’ messaging, you must complete identity verification through Stripe Identity. Verification may require an image of your face and government-issued photo ID.

   • Data Use: Verification data is collected and processed by Stripe and its service providers to confirm your identity and prevent fraud. We receive only the result (pass/fail and limited metadata) and store it in accordance with our Privacy Policy.

     Accuracy: Information you submit must be true, complete and up-to-date. Submitting false or unreadable documents may lead to suspension or termination.

   • Regulatory Compliance: These checks help us comply with Australian Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) obligations.

   • Failure to Verify: If you do not complete verification within the timeframe we specify, or if verification fails, we may cancel your listings and/or close your account.

5. Chat Function

   • Purpose: Our chat function is provided for customer support and a easy communication with other users. By using the chat, either direct messaging, phone or email, you agree to engage respectfully and in accordance with our User Conduct guidelines.

   • Monitoring: We may monitor and record interactions on the live chat for quality assurance and training purposes.

6. Intellectual Property

   • Ownership: All content and materials posted to our website from users, including text, graphics, logos, and images, are the property of user who posted the items or their licensors and are protected by intellectual property laws.

   • License: We grant you a limited, non-exclusive, non-transferable membership to access and use our website and services for personal and commercial purposes.

7. Limitation of Liability

   • Disclaimer: Our website and services are provided on an “as is” and “as available” basis. We do not guarantee that our services will always be available or error-free.

   • Limitation: To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services.

   • Third-Party Services: We are not responsible for acts or omissions of Stripe or other third-party service providers. Your relationship with those providers is governed by their own terms and policies.

   • You agree to indemnify and hold harmless Broadacre Contracting, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of our website or services or your violation of these Terms of Service.

   • We reserve the right to suspend or terminate your access to our website and services at any time and for any reason without notice.

    • We may revise these Terms of Service at any time by posting the updated terms on our website. By continuing to use our website after the revisions come into effect, you agree to be bound by the revised Terms of Service.
