Terms of Service

Welcome to Broadacre Contracting. These Terms of Service (the “Terms”) govern your access to and use of our website broadacrecontracting.au (the “Website”) and any services, features, content or applications made available through it (collectively, the “Services”).

1. Acceptance of Terms

By accessing or using the Website or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree with any part of these Terms, you must not access the Website or use the Services.


2. Eligibility & Account Requirements

2.1 Age Requirement

You must be at least 18 years of age and capable of entering into a binding legal agreement to use the Services. By using the Website, you represent and warrant that you meet these requirements.

2.2 Account Creation and Security

Certain features of the Services may require you to create an account. You are solely responsible for:

  • Maintaining the confidentiality and security of your login credentials; and
  • All activities that occur under your account, whether authorised by you or not.

You must promptly notify us if you become aware of any unauthorised use of your account or any other breach of security.


3. Use of Services

3.1 Acceptable Use

You agree that you will not use the Website or Services for any unlawful, unauthorised, or prohibited purpose. Without limiting the foregoing, you must not:

  • Use the Services in any manner that could damage, disable, overburden, or impair our servers, systems, or networks; or
  • Interfere with or disrupt the use and enjoyment of the Website or Services by any other person.
3.2 Chat Function

The Website may provide a chat function and other communication channels (including direct messaging, phone, or email) to facilitate support and communication between users and our team.
By using these channels, you agree to:

  • Engage respectfully and professionally at all times; and
  • Comply with these Terms and all User Conduct requirements set out in these Terms.

We may monitor and record interactions on the chat function and other communication channels for quality assurance, training, and compliance purposes.


4. Unauthorised Use or Distribution of Content

Users must not, under any circumstances:

  • Access, download, reproduce, distribute, share, record, screenshot, or otherwise disclose any paid-member, restricted, confidential, or proprietary content made available through the Services without the express prior written permission of Broadacre Contracting; or
  • Sell, publish, sublicense, or provide access to such content to any third party; or
  • Circumvent or attempt to circumvent any access controls, digital rights management, or other technical protections implemented on the Website or Services.

All content made available to paid members or registered users remains the exclusive property of Broadacre Contracting (or its licensors) and is provided for your personal access only, unless expressly stated otherwise.
Unauthorised use, reproduction, or distribution of such content constitutes a breach of these Terms and may also infringe applicable copyright, privacy, and other laws.


5. Inappropriate Behaviour (Zero-Tolerance Policy)

Broadacre Contracting maintains a zero-tolerance policy toward behaviour that compromises the safety, dignity, or wellbeing of our community.
Users must not:

  • Harass, bully, insult, threaten, intimidate, discriminate against, or otherwise abuse any member of the platform or any member of the Broadacre Contracting team; or
  • Engage in hostile, disruptive, or inappropriate interactions that conflict with the values, mission, or community standards of Broadacre Contracting; or
  • Create, upload, or distribute content intended to cause harm, distress, or disruption.

We may take any action we consider appropriate (including suspension or termination of your account) if we believe, in our sole discretion, that your conduct breaches this section.


6. Payment & Billing

6.1 Payment Processor

All card payments made via the website are processed by Stripe Payments Australia Pty Ltd (“Stripe”). By making a payment, you also agree to be bound by the Stripe Services Agreement and any Stripe-specific terms that apply to your chosen payment method.

6.2 Authorisation

You authorise Broadacre Contracting (or Stripe acting on our behalf) to charge the payment card you nominate for all fees, charges, taxes, and other amounts incurred in connection with your use of the Services.

6.3 Subscriptions & Automatic Renewals

If you subscribe to a recurring plan, you acknowledge and agree that:

  • Payments will automatically renew at the end of each billing cycle; and
  • It is your responsibility to manage and cancel your subscription before the renewal date if you do not wish to continue; and
  • Once a renewal payment has been processed for a billing period, no refunds will be issued for that billing period, except as required by law.
6.4 Pricing & Taxes

Unless expressly stated otherwise, prices are quoted in Australian dollars (AUD) and include GST.
You are responsible for any other applicable taxes, duties, or charges that may arise from your use of the Services.

6.5 Changes to Fees & Payment Methods

We may add or remove payment methods or revise our fees on at least 14 days’ notice, which may be provided by posting an update on the Website or by other reasonable means.
Your continued use of any paid Services after the notice period has expired constitutes your acceptance of the revised fees and/or payment methods.

6.6 Refunds & Cancellations

We comply with the Australian Consumer Law and Stripe’s refund processes. If you are entitled to a refund, we will instruct Stripe to credit the original payment card, and the timing of the refund will depend on the card network and issuing bank.
Once a full refund has been processed, disputes and chargebacks in respect of that transaction are not possible.

By opting into a subscription plan, you expressly authorise Broadacre Contracting and Stripe to automatically charge your nominated card at the interval you select until you cancel your subscription in accordance with this section.

6.7 Chargebacks & Disputes

You agree to contact us first to attempt to resolve any billing or payment issue. If you lodge a chargeback contrary to these Terms and we reasonably believe that the chargeback is unfounded or abusive, we may:

  • Suspend or terminate your account; and/or
  • Recover from you any associated costs, fees, or charges to the extent permitted by law.
6.8 Failed or Late Payments

If a payment fails, is declined, or is reversed, we may suspend or restrict your access to the Services until all outstanding amounts (including any Stripe dispute fees) have been paid in full.

6.9 Payment Security

We do not store complete payment card numbers on our systems. Stripe handles all card data in accordance with PCI-DSS Level 1 security standards.


7. Identity Verification

7.1 Verification Requirement

To remove “unverified” messaging or status on your account, you may be required to complete identity verification through Stripe Identity. This process may involve providing an image of your face and a valid, government-issued photo ID.

7.2 Data Use

Verification data is collected and processed by Stripe and its service providers for the purposes of confirming your identity and preventing fraud. Broadacre Contracting receives only the result of the verification (for example, pass/fail and limited metadata) and handles this information in accordance with our Privacy Policy.

7.3 Accuracy of Information

All information and documents you submit for verification must be true, complete, current, and legible. Submitting false, misleading, or unreadable documents may result in suspension or termination of your account.

7.4 Regulatory Compliance

These verification checks assist us in complying with Australian Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) obligations and other applicable laws.

7.5 Failure to Verify

If you do not complete verification within the timeframe we specify, or if your verification is unsuccessful, we may cancel active listings associated with your account and/or close or restrict your account.


8. Intellectual Property

8.1 Ownership

Content and materials posted to the Website by users, including text, graphics, logos, and images, remain the property of the user who posted the items or their licensors. All other content, including the overall look and feel of the Website, is owned by Broadacre Contracting or its licensors and is protected by intellectual property laws.

8.2 Licence to Use the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Website and Services for personal and commercial purposes in connection with Broadacre Contracting’s marketplace.
No other rights or licences are granted to you, whether expressly or by implication.


9. Investigations & Monitoring

Broadacre Contracting reserves the right, but not the obligation, to:

  • Monitor user activity on the Website and Services for the purpose of enforcing these Terms and protecting our community;
  • Review, investigate, and assess user behaviour based on internal reports, user complaints, automated systems, or other reasonable methods; and
  • Request information or clarification from users as part of any investigation.

Investigations may be conducted with or without notice to you. We may take any action we consider appropriate in response to an investigation, including suspension or termination of your account.


10. Limitation of Liability

10.1 Disclaimer

To the maximum extent permitted by law, the Website and Services are provided on an “as is” and “as available” basis.
We do not represent or warrant that the Services will be uninterrupted, secure, error-free, or free from viruses or other harmful components.

10.2 Limitation of Liability

To the fullest extent permitted by law, Broadacre Contracting and its officers, directors, employees, and agents will not be liable for any direct, indirect, incidental, special, consequential, or punitive loss or damage arising out of or in connection with:

  • Your access to or use of, or inability to access or use, the Website or Services; or
  • Any conduct or content of any user or third party.

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantees or rights that cannot lawfully be excluded under the Australian Consumer Law.

10.3 Third-Party Services

The Services may integrate or interact with third-party service providers (including Stripe). We are not responsible for the acts or omissions of any third-party provider, and your relationship with them is governed by their own terms and policies.


11. Indemnification

You agree to indemnify and hold harmless Broadacre Contracting, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Website or Services; or
  • Your breach of these Terms or any applicable law.

12. Termination

We reserve the right, at our sole discretion, to suspend, restrict, or terminate your access to the Website and Services at any time and for any reason (including, without limitation, a breach of these Terms), with or without notice.
To the extent permitted by law, no refunds or compensation will be payable in respect of any suspension, restriction, or termination arising from your breach of these Terms.


13. Changes to These Terms

We may revise or update these Terms from time to time. Any changes will be effective when posted on the Website (or on a later date specified in the updated Terms).
By continuing to access or use the Website or Services after changes take effect, you agree to be bound by the updated Terms.


14. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia in respect of any dispute arising out of or in connection with these Terms or the Services.


15. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable, and the remaining provisions will continue in full force and effect.
